Denver Social Marijuana Use Licensing Open To New Businesses in Denver; however, it’s not looking to be so simple.
For one, attaining licensing will involve an extensive process that may discourage applications, and some are expecting a delay in an initial batch of license requests. The lead proponents of Initiative 300, which passed last November and brought social use into play, are even considering suing for the extensive hassle involved with applying for licensing, including stringent rules on location which prohibit social use locations from being within 1,000 feet of schools, alcohol and drug treatment centers, as well as child-care facilities. Other requirements for businesses that want to provide 21-and-over areas for bring-your-own-marijuana consumption include obtaining approval from a nearby neighborhood or business group, extensive supporting documentation and plans, and paying a $1,000 application fee.
Though dispensaries can’t have social smoking on their premises, their owners could open separate spaces as close as next door for social consumption. Additionally, the state imposes restrictions on businesses with liquor licenses; this means it’s more likely for businesses like coffee shops and even yoga studios to apply for licensing.
In an email to other members of an advisory committee that helped suggest rules, I-300 campaign manager Emmett Reistroffer suggested that the four year pilot of the program “is set up to fail.”
However, the Denver Department of Excise and Licenses disputes that claim and says they’re prepared to start accepting cannabis consumption establishment licenses and is expecting to begin accepting applications for a second kind of license that would allow for cannabis consumption at special events that wouldn’t be allowed to be hosted on public property.
Though the 1,000-ft barriers will certainly disqualify many areas of Denver for these kinds of establishments and various complications, it’s still a step forward in the experiment of legalization. We need more Denver Social Marijuana Use Licenses for sure!
